Lawyers representing an asylum seeker family facing a transfer to Nauru will argue that their newborn baby is too sick to be moved.



Latifar, a Rohingyan woman from Myanmar, gave birth to Ferouz in the Mater Hospital on November 10, after her family was moved from the Nauru processing centre to Brisbane.




As Fairfax Media revealed this month, Latifar was separated from her baby four days after giving birth and was only allowed to visit him for six hours a day, despite the newborn having respiratory problems.



The Federal Circuit Court in Brisbane is expected to hear the case on Tuesday, where lawyers representing the family will make an urgent request to keep them on the mainland.




"Ferouz is still very weak – he is just two weeks old and continues to struggle with breastfeeding while his mother Latifar is recovering from a caesarean," Maurice Blackburn Lawyers associate Murray Watt said.



"They are in no state to be transferred to Nauru, where they will have limited access to the specialist care and support they have been receiving in Brisbane," he said.



Mr Watt said the case was significant because it tested the right of an asylum seeker to present independent medical health advice before facing a transfer to detention.



Mr Watt said there was "a real question" on whether the government could transfer Ferouz to Nauru, given he was born in Australia.



However on Friday, Immigration Minister Scott Morrison said there were no exceptions to the rule of offshore processing for any individuals who arrived illegally by boat after July 19.



"That is the government's policy. And when there are medical clearances that are in place for people to return to Nauru, in the case of families, then that is what would occur," he said.
